The rules, plain and clear.

These terms of sale and use (the "Terms") govern access to and use of the Kleym service, published by THE BROWZ (see the legal notice). By creating an account or subscribing to a plan, you accept these Terms without reservation.

Kleym is intended for professionals (creators acting in the course of their business, whether self-employed or through a company). By subscribing, you confirm that you are acting for business purposes.

Kleym is an online service that: monitors, in Meta's public Ad Library, the delivery of the videos you import into the service, visually recognises your videos among your brands' ads, spots rights overruns, calculates an indicative amount to claim, and prepares claim material (a pre-filled message and a Proof of Ad Delivery report).

Kleym collects no money on your behalf and sends no claim for you: it prepares the material, and you decide whether or not to send the request to the brand. Estimates and reports are provided for information only and do not constitute legal advice.

• Signing up requires a valid email address and a password (or sign-in through a third-party provider).
• You are responsible for keeping your credentials confidential and for any activity carried out from your account.
• The information you provide must be accurate and kept up to date.
• An account is strictly personal and cannot be transferred.

Kleym offers three plans. Prices are shown excluding VAT. Applicable taxes are added at payment and calculated automatically by our payment provider based on your location and status. For a customer established in France, this is French VAT at the current rate (20%). If you are a business established in another European Union country and provide a valid intra-EU VAT number, no VAT is charged (reverse-charge mechanism). • Discovery: free, limited to 3 tracked brands and 10 videos; claim message included. The proof report is not included (a sample with fictitious data can be viewed in the app).
• Creator: €19.90/month excl. VAT (€50.75/quarter, 15% off; €179.10/year, 25% off), 30 tracked brands, unlimited videos. Add-on pack: €9/month excl. VAT per 10 extra brands.
• Super Creator: €49.90/month excl. VAT (€127.25/quarter; €449.10/year), 100 tracked brands. Add-on pack: €7/month excl. VAT per 10 extra brands.

Billing is in advance, for the cycle you choose (monthly, quarterly or yearly). Brand packs follow your subscription cycle, with the same discount (Creator: €22.95/quarter or €81/year excl. VAT; Super Creator: €17.85/quarter or €63/year excl. VAT). They are prorated when added; removing a pack takes effect at the end of the current period, with no refund for the period already started.

A free 7-day trial, no card required, is available on the Creator and Super Creator plans, once per account. Nothing is charged during the trial and there is no automatic switch to a paid plan. If you subscribe to a paid plan during the trial, your card is saved but not charged straight away: billing starts automatically when the trial ends. If the trial ends without a subscription, the account returns to the free Discovery plan; no data is deleted: brands over the limit are paused (the oldest stay tracked, the others are no longer monitored but remain viewable) and adding new videos is blocked over the limit, until you subscribe.

Payments are processed securely by Stripe Payments Europe, Limited (https://stripe.com). Kleym never stores full card details. By subscribing to a paid plan, you authorise recurring charges of the corresponding amount, including applicable taxes, at each billing date, as well as the prorated amounts provided for in these Terms (adding brand packs, upgrading).

If a payment fails, access is maintained during a 7-day grace period while further charge attempts are made. If payment is still outstanding after that period, access to paid features is suspended and the account returns to the Discovery plan (no data is deleted).

Your subscription runs for the billing cycle you chose and renews automatically for the same duration unless cancelled. You can cancel at any time from your billing area or by writing to support@kleym.app. Cancellation takes effect at the end of the current period; the period already started is not refunded.

You can change plan or billing cycle at any time from your billing area. If the new option costs more, the change applies immediately and the difference is prorated over the current period. If it costs less, the change is scheduled for the end of the current period, with no credit or refund, and you can cancel it as long as it has not taken effect.

On quarterly and yearly subscriptions, you can request a temporary pause (1 to 2 months) by writing to support: each request is reviewed individually and, if granted, pushes back the end date of your subscription by the same amount. Details are in the refund and cancellation policy.

You can also delete your account at any time from your settings. Deletion becomes final after a 7-day cancellation window; remember to cancel your subscription first. Details are in the privacy policy.

Kleym is provided to professionals in the course of their business, so the consumer right of withdrawal under the French Consumer Code (Code de la consommation) does not apply in principle.

If you were nonetheless deemed a consumer or non-professional within the meaning of the French Consumer Code, you would in principle have a 14-day withdrawal period. By ticking the box at checkout, you expressly request that performance of the service begin immediately and acknowledge that you lose your right of withdrawal from that moment, in accordance with article L.221-28 of the French Consumer Code.

You agree, among other things, not to:

• use the service for unlawful purposes or in breach of third-party rights;
• import content for which you do not hold the necessary rights;
• attempt to bypass your plan limits, disrupt the service, or extract its data by automated means;
• use the reports or estimates in a misleading or defamatory way.

In the event of a serious breach, access to the service may be suspended or terminated without notice.

Kleym uses reasonable efforts to keep the service available, without guaranteeing uninterrupted operation. The service may evolve, and maintenance may be required. Kleym depends on third-party sources (in particular Meta's Ad Library) whose availability and completeness it does not control. In particular, actual delivery may go undetected, or be detected late, and conversely an ad may be wrongly matched to one of your videos. Detections, estimated amounts and reports are provided for information only; it is up to you to verify them before approaching a brand.

Kleym cannot be held liable for the consequences of the claims you choose to pursue, nor for indirect loss. To the extent permitted by law, Kleym's total liability is capped at the amounts you actually paid over the last twelve months. This cap does not apply in cases of wilful misconduct or gross negligence, nor in other cases where the law does not allow liability to be limited.

Your subscription gives you a personal, non-exclusive and non-transferable right to access and use the service for the duration of your subscription. Intellectual property rights in the service are detailed in the legal notice. How your personal data is processed is described in the privacy policy.

Kleym may update these Terms. In the event of a substantial change, you will be informed by email and/or through the service at least 30 days before it takes effect. If you do not accept the change, you can cancel your subscription before that date; otherwise, continued use counts as acceptance of the new Terms.

These Terms are governed by French law. In the event of a dispute that cannot be resolved amicably, the competent French courts will have jurisdiction. For any complaint, write first to support@kleym.app.
